How Chapter 13 Bankruptcy Works

In Chapter 13, a bankruptcy trustee sets up a three- to five-year debt repayment plan. You make affordable monthly payments to the trustee, and at the end of the payment period, your remaining dischargeable unsecured debts (such as credit card bills, medical debts) are eliminated.

Generous exemptions can enable you to keep much or all of your property, such as vehicles, personal property and retirement funds. Chapter 13 also serves to protect your credit rating to a greater degree than Chapter 7.
