Assault with a Deadly Weapon

Felonious assault is a major crime, but often the charges stem from a fight or altercation in which events escalated quickly and got out of hand. If you are accused of assault with a weapon or attacking someone and causing serious injury, you will need skilled representation to challenge the prosecution's version of events and avoid a long prison sentence.

I am David G. Moore, an experienced Grand Rapids assault with a deadly weapon defense lawyer who can protect your rights and assert your viable defenses if you are accused of felony assault. As a former prosecutor and as a criminal defense lawyer, I have handled serious felony cases in Kalamazoo County and surrounding counties of Southwest Michigan. Skilled Defense Against Felony Assault Charges

Simple assault refers to pushing, shoving and threatening gestures. Aggravated assault refers to lasting injury such as a black eye or worse. These are misdemeanor offenses.

  • Assault with a dangerous weapon (also known as felonious assault) is a serious felony crime punishable by up to four years in prison. This includes any objects that might put someone in fear for his or her life, such as guns, knives, baseball bats or broken bottles.
  • Assault with intent to do great bodily harm (with or without a weapon) is another tier of felonious assault, punishable by up to 10 years in prison.
  • Assault with intent to rob is a high felony that carries a prison term of 15 years (unarmed) to life in prison (armed assault).

For any charge of felonious assault, I thoroughly examine the police reports, witness accounts and other evidence to explore possible defenses. Was it self-defense? Provocation? Mutual combat? Was the weapon actually brandished, or was it merely in the accused's possession? Was there really intent to cause harm?

As your attorney, I look at the charges against you from all angles to try to spare you from a felony conviction and time behind bars. I also explore negotiations for lesser charges or alternative punishments to prevent an isolated event or heat-of-the-moment choice from ruining a young person's life.
